TO: Gov. Pataki, Sen. Bruno, Sen. Morahan, Sen Larkin, Sen. Bonacic
PETITION AGAINST PATAKI’S PLAN TO CANCEL ALL
“ UNTIL REVOLKED” HANDGUN LICENSES, ADD UNLIMITED FEES,
REQUIRE 5 YEAR RECERTIFICATION AND OTHER REQUIRMENTS. We strongly oppose Gov. George Pataki’s
budget proposal S6056/A9556. Implementation of the proposed changes
in New York Penal law Section 400.00, will severely impact everyone
who has
been issued a license that is good “until revoked” and
all who apply for a license in the future.
We object to the new $100 state fee and the provision
that allows for counties to charge an unlimited fee. (Currently Nassau charges
$200,
NY City plans
to charge $340 however
nothing in the law will prevent counties from charging $1,000
or more.) We object
that the 5-year license recertification that must be approved “BY
THE LICENSING OFFICER”. We object that thousands of
current license holders must be process in just a few months,
something
no county in
NY is capable of doing. We object that no provision is included
that mandates
that each county contact each license holder to notify them
of the provisions of the new law.
If this law is adopted it will amount to a ban on handgun ownership
by all citizens except those who are rich enough to afford the new
fees. It is
outright discrimination against the poor and those on fixed incomes.
If this law is adopted, on Feb. 2nd, 2005, tens of thousands of people
who
now possess what they think is a “Lifetime License,” will
become instant felons, subject to arrest and confiscation
of all of their guns,
not just their licensed handguns.
When Gov. Pataki first ran for office he promised that he would not
propose new gun laws like the ones proposed by Gov. Mario Cuomo including
Cuomo’s
proposal for renewable handgun licenses. Cuomo’s renewable license
proposal was defeated and Gov. Pataki’s proposal
should also be defeated.
