Herald-Record attacks AG Ashcroft and NICS gun records.
The TH-R is at it again even
if it has to lie about it. On 12/11/01 the Record's editorial page
published, "Don't
question people's loyalty." Among other things it said:
"Tough guy John Ashcroft has rounded up
more than a thousand people for questioning about terrorism and detained
hundreds of them without filing charges against them and without revealing
who they are."
And Ashcroft is quoted as saying, "Your tactics
only aid terrorists, for they erode our national unity and diminish resolve.
They give ammunition to America's enemies and pause to America's friends.
They encourage people of goodwill to remain silent in the face of evil."
And then, this purported upholder of the law and uprooter
of evil denies his own FBI the right to check gun-purchase records to find
out if any of those thousand-plus people he has detained for questioning
as possible terrorists may have bought guns."
The following is some information that I looked up that
the TH-R failed to. (So much for them knowing what they are talking
about. They never need the facts to attack Ashcroft or gun rights.)
It amazes me that so many people have forgotten how much of a big deal
it was that the NICS records for people who passed the check would not
be turned into a registration of guns and gun owners and that only the
FBI could use the records to audit the system. Without the required
changes that guaranteed the gun owners privacy the bill would not have
passed. Sen. UpChuck should know because he voted for the bill with
the restrictions on access to the information in 1993.
The editorial quotes Sen. UpChuck Schumer as saying,
""but when it comes to the area of even illegal immigrants getting guns,
(you're (Ashcroft)) as weak as a wet noodle." Oh really! If
the AG was not following the law the anti-gun Senators could file a lawsuit to force the records to be made available but instead what did UpChuck
and the rest of them do? They introduced Senate
Bill S. 1788 TO CHANGE CURRENT LAW to "allow the Federal
Bureau of Investigation to access NICS audit log records for the purpose
of responding to an inquiry from any federal, state, or local law enforcement
agency in connection with a civil or criminal law enforcement investigation."
Notice
that the new bill does not limit record access to people being investaged
about terrorism, rather, the new law would allow any police department
to investigate your recent gun purchases because they gave you a parking
ticket?

SUMMARY: The United States Department of Justice (DOJ) is publishing
a final rule implementing the National Instant Criminal Background Check
System (NICS) pursuant to the Brady Handgun Violence Prevention Act (‘‘Brady
Act’’), to provide notice of the establishment of the NICS, to establish
policies and procedures for ensuring the privacy and security of this system,
and to implement a NICS appeals policy for persons denied acquisition of
a firearm based on information in the NICS that they believe to be erroneous
or incomplete.

Various comments expressed concern that the Audit Log would allow POCs
and law enforcement agencies access to records of approved transfers. This
is not a well-founded concern because only the FBI will be able to access
information in the transaction log. Section 25.9(b)(1) of the final rule
was revised to provide explicitly that such information is available only
to the FBI, and only for the purposes of conducting audits of the use and
performance of the NICS or pursing cases of misuse of the system.

And just so that I know that I am getting it right;
Sen. UpChuck Schumer wants to allow anyone to look at the records of everyone
who has bought a gun in the last 90 days so that they can investigate the
purchases of people who have not been charged in any crime and who the
NICS system found legally able to purchase a firearm. They will be
looking for people who were not legally allowed to own a firearm because
they were "Illegal aliens" so that they can charge the person with a crime
and who's lawyer will ask for the charges to be dismissed because the evidence
from the NICS record were obtained illegally per the law and the intent
according to the Congressional Record and the Federal Register.
And just so I make sure that I am remembering it
right, aren't the same people who are criticizing Ashcroft now the first
ones to criticize and call people racist when someone talks about dealing
with the problems of illegal aliens or if someone suggest that the INS
do their job and track down those illegal aliens who's visas have run out
or are illegal for other reasons? Is Sen. UpChuck going to introduce
a bill requiring the INS to supply the NICS system an up to date list of
every illegal alien and that requires the INS to track down, hold and deport
all illegal aliens in the US?

Hunting East of Durry Lane on Stewart Airport, State Police want no parking
on Durry Lane
Things are changing as far as hunting around
Durry Lane. No hunting is allowed east of Durry Lane. This
is a change from what has been allowed for the last 20+ years from
what I have been told. I am still trying to find out what the facts
are but I have talked to one person who was given a $50 ticket for bow
hunting on the south east corner of Durry lane where it meets RT. 207.
While the person said that some signs were in the area he did not see one
in the area that he parked in and was told it was a new change. He
got the ticket on 11/24/01 and will be going to court on 12/13/01.
I will post an update when I get more information.
While I was trying to check up on what was going
on with the hunting I talked to the NY State Police and they said that
they had requested that the DEC end all parking on Durry Lane on both sides.
If they do that, about 6 parking spots will be eliminated. Now I
can understand them wanting to close off any parking spaces at the end
of the runway. I really can not understand why they would want to
close off parking spaces that are further away.

Anti-gun
NY Senator, R-26, might quite Senate
The New York Post is reporting antigun State Senator
Roy Goodman (R-26) is considering leaving the Senate to take a job with
NYC mayor-elect Michael Bloomberg.
The post also reports Assemblyman John Ravitz (R-73)
is eyeing Goodman's seat. Neither Ravitz nor last year's Democratic
challenger Liz Krueger are gun rights supporters.
Senator Goodman is best know for his bill banning
all handguns that he submits every year. Last year when the anti-gun
bills were passes, one of the reasons given was that the new laws were
needed so that the Republicans could keep control of the NY State Senate.
Sen. Goodman was one of the people who's was named as someone who would
be helped in reelection if the anti-gun bills passed. Sen. Goodman
won by a very, very narrow margin of less than 1% vote. Now he is
going to quit, Thanks.
Delaware
System Drought Emergency Impacts Fishing
Combined storage in Neversink, Pepacton, and Cannonsville
reservoirs declined into "Drought Emergency" conditions on November 26,
triggering a mandated drop in base releases to tailwaters. Base releases
are 5 cubic feet per second (cfs) in the Neversink, 8 cfs in the W. Branch
Delaware below Cannonsville, and 6 cfs in the E. Branch Delaware below
Pepacton.
DEC is attempting to reach an agreement to establish
emergency flows equal to base summer flows of 15 cfs in the Neversink,
19 at Pepacton, and 23 at Cannonsville when combined storage in the Delaware
system reservoirs is at or above the midpoint of the "drought zone" range.
In either case, releases below the three NYC Delaware
reservoirs are expected to be well below normal for quite a long time.
Impacts to the tailwaters will depend on the amount of natural runoff and
winter temperatures. Dry conditions obviously worsen the impact of
reduced releases, and cold weather converts part of the runoff to ice and
promotes formation of anchor ice which can decimate eggs and insects by
scouring the streambed. ( The freeze will kill fish eggs and the
insects that the fish will feed on when they hatch in the spring.)
Bush
Expected To Name Comey N.Y. Prosecutor
Pres. Bush is expected to name Veteran federal
prosecutor James B. Comey as the new U.S. attorney in Manhattan.
It looks like he will be approved by Sen. UpChuck Schumer. Comey
set up the Project Exile in Richmond, VA and worked under anti-gun Mayor
Giuliani, when he was the U.S. attorney in New York

Survey:
Top Cops Favor Concealed Carry Laws

(CNSNews.com) - A survey released Friday by the National Association
of Chiefs of Police finds that over 60 percent of the nation's police chiefs
and sheriffs favor a national system allowing law-abiding citizens to carry
concealed firearms.
The survey asked 23,113 chiefs and sheriffs around the country, "Do
you agree that a national concealed handgun permit would reduce rates of
violent crime as recent studies in some states already reflected?" According
to the National Association of Chiefs of Police (NACOP), 62 percent of
those surveyed said "yes."

DOLE TAKES MORE PRO GUN STANCE
Elizabeth Dole, seeking the Republican Party nomination to succeed North
Carolina’s retiring Senator Jesse Helms, is changing her position on gun
control. As a Republican presidential candidate in 2000, Dole supported
banning certain semiautomatic firearms, and criticized state laws allowing
citizens to carry concealed firearms. Now, the former head of the American
Red Cross and wife of former U.S. Senator and presidential candidate Bob
Dole, says new restrictions are not needed “on those who already observe
the thousands of gun laws on the books.” In a recent letter to the North
Carolina Rifle and Pistol Association, Dole explained that the ban on “assault
weapons” apparently has had “little effect on crime prevention” and wants
to review its effectiveness. She also now believes that North Carolina’s
right-to-carry law is working and is a “common sense proposal.” She believes
that what is effective “is the Instant Check System. We should stick with

Rise in Gun Sales Reflects Post-Attack Fears

Since Sept. 11, more Americans are taking what
many consider to be the most personal step toward feeling safer: arming
themselves. Gun and ammunition sales across the country have
risen sharply since Sept. 11 as more Americans take what many consider
to be the most personal step toward feeling safer: arming themselves.
According to statistics from the Federal Bureau
of Investigation, surveys by firearms associations and anecdotal evidence
from storefront gun shops and distributors from Arizona to Florida to Lower
Manhattan, the jump in weapons sales followed quickly on the first jarring
images of the terrorist attacks.

Please note that the FBI are not notified of
any handgun or long gun sales for people, like most NY state handgun owners
who are exempt, for the most part, from having the NICS check done because
the FBI allows us to have an exemption because of the way our license works.

1062, Demilitarization Bill Killed!
Thanks in large part to the efforts of U.S. Representative
Bob Stump (R-Ariz.), the House Armed Services Committee Chair, Section
1062 of S. 1438, the "National Defense Authorization Act for FY 2002,"
was stripped from the House-Senate Conference Committee`s final report.
Sec. 1062-included at the last minute in the version of the Defense Authorization
bill passed by the Senate, but not in the House`s version-sought to provide
the Secretary of Defense with the authority to require "demilitarization"
of any "significant military equipment" that has ever been owned by the
Department of Defense (DoD). This would include firearms (such as
the venerable M1, M1 Carbine, and Model 1911, as well as all Civilian Marksmanship
Program rifles, even "sporterized" surplus bolt-action Springfields!),
firearm barrels, ammunition, and gun powder. "Demilitarization" is
the term for rendering such items permanently inoperable. Sec. 1062
would have allowed for this action to be carried out either by the owner
or a third par

entire pro-gun community, as do those NRA members and other activists who
took the time to contact members of the House-Senate Conference Committee
to urge them to strip Sec. 1062 from the "National Defense Authorization
Act for FY 2002."

GUN SHOW rules are not just about the NICS check.
They are at it again but this time they are using 9/11
to help push the NICS check at gun shows. Sen. Reed has his own bill,
S. 767, is identical to the bill former Sen. Frank Lautenberg introduced
in the previous Congress. And like its predecessor, it calls for massive
new government powers to register gun show customers, register gun owners,
retain information on people who pass criminal records checks when buying
firearms, heavily tax both gun collectors and gun sales, and require gun
show promoters to police gun show customers, as if they were agents of
the Bureau of Alcohol, Tobacco and Firearms.

890. This bill will impose unprecedented federal control over
gun shows nationwide. Centralized federal licensing and registration of
every gun show promoter in the nation. Centralized federal registration
of every vendor, including non-gun vendors at all gun shows in the country.
Centralized federal registration of EVERY PERSON who attends a gun show
in America whether they make a purchase or not. Centralized collection
of “any other information” on gun show attendees, determined solely by
the Secretary of the Treasury. Imprisonment for attending a gun show and
failing to give up any information required by the Secretary of the Treasury.
Imprisonment of any gun show promoter who fails to register a single vendor.
Imprisonment of gun show promoters who cannot prove they notified every
person attending a gun show of the new rules. Centralized collection of
“any other information” the Secretary of the Treasury decides necessary
on vendors, attendees and the gun show itself. Submission by gun show promoters
of vendors’ regulation logs 30 days before any gun show, and submission
of updated vendor registration logs 72 hours before any gun show. Submission
of vendor regulation logs within 5 days of the close of any gun show. Identification
of vendors only by use of federally approved photo id that may include
use of a social security number, electronically encoded data, or “biometric
identifiers” such as fingerprint, voiceprint, retina scan, and iris scan.
Creation of a new license (in addition to a gun show promoter license),
similar to FFL’s, for individuals who want access to the NICS National
Instant Check System for facilitating gun show sales for
private citizens. And it goes on and on and on.

Product Safety Commission files lawsuit against the Daisy to recall of
7.5 million Powerline Airguns
The U.S. Consumer Product Safety Commission (CPSC)
filed an administrative lawsuit against the Daisy Manufacturing Co. (Daisy),
doing business as Daisy Outdoor Products, of Rogers, Ark., seeking a recall
of 7.5 million Powerline Airguns. The lawsuit seeks to compel Daisy to
notify consumers that the model 880 and model 856 Powerline Airguns are
defective, and present a substantial risk of death or injury to anyone
using the airgun. Daisy has refused to voluntarily recall these BB guns,
which have been sold since September 1972 in sporting goods, department,
and hardware stores, as well as on the Internet.
