I have had a Yahoo Forum for several years but because the newsletter format that I used to have took too long I am going to use the forum instead. You will have to join but you will be able to add articles that I will list. All articles will have to be approved by me but I will not check spelling. Keep them short and have links to related articles, reports or related information. You can select not to get any emails and just check the forum when you want to.
WE WIN (in part)
The Court has released the opinion in District of Columbia v. Heller (07-290), on whether the District’s firearms regulations – which bar the possession of handguns and require shotguns and rifles to be kept disassembled or under trigger lock – violate the Second Amendment. The ruling below, which struck down the provisions in question, is affirmed.
Justice Scalia wrote the opinion. Justice Breyer dissented, joined by Justices Stevens, Souter and Ginsburg.
Quoting the syllabus: The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home.
"We are aware of the problem of handgun violence in this
country, and we take seriously the concerns raised by the
many amici who believe that prohibition of handgun
ownership is a solution. The Constitution leaves the
District of Columbia a variety of tools for combating that
problem, including some measures regulating handguns,
see supra, at 54–55, and n. 26. But the enshrinement of
constitutional rights necessarily takes certain policy
choices off the table. These include the absolute prohibition
of handguns held and used for self-defense in the
home. Undoubtedly some think that the Second Amendment
is outmoded in a society where our standing army is
the pride of our Nation, where well-trained police forces
provide personal security, and where gun violence is a
serious problem. That is perhaps debatable, but what is
not debatable is that it is not the role of this Court to
pronounce the Second Amendment extinct." PG64
May 19, 2008 - Governor Paterson, with City Council Speaker Christine Quinn and other gun control advocates, announces legislation that would reduce gun violence.
The Governor's proposed legislation contains numerous other provisions to enhance public safety, including measures that would help law enforcement prevent guns from getting in the hands of criminals. For example, the bill:
Requires employees of gun shops who handle and sell guns to undergo a criminal background check, and eventually to obtain a gun license;
Requires that all applicants for a gun license successfully complete a gun safety course. (WHO KNOWS HOW HARD THEY WILL MAKE IT OR WHAT OTHER REQUIRMENTS IT WILL HAVE?)
Requires the Superintendent of State Police to issue regulations to ensure that gun shops are operating securely and to ensure that gun shop employees are properly trained in gun safety and laws regulating the purchase and sale of firearms; (I AM SURE THAT THEY WILL MAKE IT EASY ON THE GUN STORES -- NOT!)
Clarifies the circumstances under which gun shops will be subject to inspection by the State Police; and,
Updates and clarifies confusing provisions in New York's gun licensing statutes that have led to their inconsistent application. (TRANSLATION: WE WANT TO STOP COUNTIES WHO ISSUE UNRESTRICED LICENSES.)
These amendments will not restrict the rights of law-abiding gun owners, but will greatly enhance law-enforcement efforts to reduce criminal activity in the State, including crimes involving the use of firearms. (I AM SURE THAT THEY ARE GOING OUT OF THEIR WAY TO PROTECT OUR RIGHTS. THAT IS WHY ONLY ANTIGUN PEOPLE WERE ON THE STAGE AND NOT ANYONE FROM THE NRA OR NYSRPA.)
WE WILL HAVE TO WAIT TO SEE WHAT THE REAL PROPOSED LAWS ARE.
