Gun owners in New York have been waiting to see how the gun laws in New York would be effected by the recent Supreme Court 2nd Amendment cases in Heller vs Washington DC and McDonald vs Chicago. In the Heller decision the Supreme Court ruled that that the “Right to Keep and Bear Arms” in the Second Amendment was an individual right and in the McDonald case the Supreme Court said that this right applied to the states.
New York gun laws were written in the 1910s and 1920s laws and are written so that the state and local government are able to discriminate against groups of people and individuals by the very vague wording in the law. One of the requirements is that a pistol license applicant must show; “ when proper cause exists for the issuance …” to be issued a handgun license. The vagueness of the wording has meant that what constitutes “proper cause” varies greatly from county to county and even from Judge to Judge in each county with some counties only issuing handgun licenses to those people who are rich, famous, politically connected and a few people who have exceptional situations.
The Second Amendment Foundation with Alan Gura, along with attorney Vincent Gelardi with Gelardi & Randazzo of Rye Brook, NY representing the plaintiffs, Alan Kachalsky and Christina Nikolov, have filed a federal lawsuit against Westchester County, New York and its handgun permit licensing officers, seeking a permanent injunction against enforcement of a state law that allows carry licenses to be denied because applicants cannot show “good cause. If the plaintiffs win their law suit, the ability of local officials to discriminate against individuals will be ended and a fairer system must be enacted.
The Second Amendment Foundation with Attorney Alan Gura recently represented McDonald in their landmark Second Amendment Supreme Court victory over the City of Chicago and also represented the plaintiffs in the Heller vs Washington DC case.
This is not a "slam dunk" case. The Heller decision included this section: "[l]ike most rights, the Second Amendment is not unlimited. It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose." The 2nd circuit has not been very friendly to 2nd Amendment cases in the past and who, with Sonia Sotomayor agreeing in the decision before she was appointed to the Supreme Court, refused to include discussion of the 2nd Amendment decision in the Heller case in a recent 2nd Amendment case that the plaintiff lost.
McDonald v. Chicago decision WE WON!!! but only by a 5 to 4 decision.
"Held: The judgment is reversed, and the case is remanded."
To quote Winston Churchill:
“This is not the end. It is not even the beginning of the end.
But it is, perhaps, the end of the beginning.”
I am very disappointed that the court did not give any guidance on how the 7th Circuit should rule. Given that the 7th ruled against the 2nd amendment, the 7th can rule that the ban is illegal but then allow unlimited regulations to restrict and limit that gun ownership. Daley has already talked about all of the rules, regulations and requirements that they want to have including insurance.
This ruling will reverse the basis of current NY law that the ability to own a pistol is a privilege, not a right. Be prepared to get out your check books cause this is going to cost a lot of money. You believe in your 2nd Amendment rights? Well get ready to put your money where your mouth it and I don't mean a $5 or $10 donation.

"Deer Hunting Sterling Forest"
Saturday August 7, two sessions
SPEAKERS:
Dick Henry, a recently retired big game biologist for NYS DEC, with a vast background in deer biology, will lead off with a talk about the
evolution of deer management and deer hunting, general deer biology (from the hunters perspective), NY hunter demographics, deer and
landscape ecology, then delve into antler restrictions generically and conclude with emerging challenges to deer management.
Matt Ross, a native of Dutchess County NY, is a certified wildlife biologist and a licensed forester with an extensive background with deer
hunters and current deer management trends. He is employed by the non-profit conservation group - the Quality Deer Management Association
(QDMA). Matt will cover the basic principles of the QDM philosophy, including the critical importance of deer population (sex ratio and age
structure) management and how you as Sterling Forest hunters are making a difference!
Wayne Masters, a renowned deer management consultant for 17 years, will do our feature presentation on field-judging whitetail bucks for age. A
management program that hopes to improve the buck age structure requires that the deer hunter pass certain age classes of young bucks. This means being able to judge the age of the whitetail buck that he or she encounters during the hunting season. Using known-age mounts and video,
this presentation is designed to teach deer hunters to recognize four age-classes of bucks "on the hoof". The method is easy to learn and
use, and is based on general antler growth characteristics. It is supported by the aging of hundreds of bucks after harvest by certified
biologists and technicians. If you plan to hunt in the park's antler restriction area, you should try to attend this excellent program!
Mark Rogers, Natural Resource Steward with the New York State Parks Environmental Management Bureau who oversees wildlife management and protection programs in State Parks, will do a presentation focusing on hunters' role in protecting the tremendous biodiversity in State Parks.
He will present data related to the 2009 deer harvest in the park.
RESERVATIONS RECOMMENDED:
To accommodate the most hunters we can, we will hold two sessions. Call (845) 351-5907 for a reservation to attend either the 8:30 AM or 1 PM
session and for directions to the seminar location. Sessions will start on time. We suggest you arrive 20-30 minutes early to find parking and
get your seat. Open seats may be released 5 minutes prior to the presentation for hunters without reservations.

I have had a Yahoo Forum for several years but because the newsletter format that I used to have took too long I am going to use the forum instead. You will have to join but you will be able to add articles that I will list. All articles will have to be approved by me but I will not check spelling. Keep them short and have links to related articles, reports or related information. You can select not to get any emails and just check the forum when you want to.
Any person or club or county federation can start a web
site. We should have one for each county in NY State. It
does not have to be as large as OCShooters but you can just
give some local information. Click above to get some ideas
