Jacob Gunther introduces NY State bill that bans frivolous lawsuits against gun industry Jacob E. Gunther III, D-C, 98th, Forestburgh, has introduced Assembly Bill A 01326, that: "Provides that manufacturers, distributors and sellers of firearms shall not be liable for death or injury due to the use of a firearm by another person; excludes actions for breach of contract or warranty or where the transferor knew or should have known of any illegal intent to use a firearm by the recipient; provides that the potential of a firearm to cause injury shall not constitute a defective condition. A companion bill, S1328, has been introduced in the Senate by Sen. Seward. |

Pleasantville WINS Orange County Pistol League Scoring a team score of 2232 in the final week of the 2002-2003 Orange County Pistol League season, Pleasantville pulled from 19 points behind the Middletown Pistol and Rifle Club, (MPRA,) to 9 points ahead to win for the 2nd year in a row. Pleasantville beat MPRA by one point last year. FINAL STANDING

NY Attorney General Eliot Spitzer set to run for
governor. http://www.spitzer2006.com is
AG Spitzer's new web site. It does not say that he is running
for governor but that is the only office that is above him
that will be open in 2006 and he will be a hard candidate
to beat. He looks good, he talks good and he has spent his
years in office bringing lawsuits against companies and gun
manufacturers and wholesalers. He was even chosen as TIME's
2002 "Crusader of the Year". Some of the lawsuits
against companies and Wall Street have been needed and he
has won many but other articles, like one in FORTUNE,
points out the weakness of his settlements and other problems.
His lawsuit against the gun industry has been his biggest
failure. He lost his main lawsuit but he still appealed
the decision himself, the first time since being elected
in 98 that he has personally appealed a decision in front
of Appellate Judges. He
wants the gun makers to: Ban crime-friendly gun models; Bar
companies from supplying retailers who have a track record
of selling to criminals; and Appoint a monitor to supervise
the gun distribution system. |

being brought or continued against manufacturers,
distributors, dealers, or importers of firearms or
ammunition for damages resulting from the misuse of
their products by others. Reckless Lawsuit Bill Introduced In US Senate CLICK HERE FOR THE WHOLE ALERT But until reckless lawsuit preemption becomes law, the firearm and ammunition industry will continue to be subject to the threat of predatory litigation. HCI and anti-gun big city mayors will continue to shop for judicial venues where they can find judges and juries that are sympathetic to their gun-ban agenda. Of course this legislation will not prevent any victim when a gun dealer or gun maker does something illegal. HCI wants to make sure that they are not prevented them from going to court against the gun industry any time anyone illegally obtains any gun and uses it illegally. |
