      Jacob E. Gunther III, D-C, 98th, Forestburgh, has introduced Assembly Bill A 01326, that: "Provides that manufacturers, distributors and sellers of firearms shall not be liable for death or injury due to the use of a firearm by another person; excludes actions for breach of contract or warranty or where the transferor knew or should have known of any illegal intent to use a firearm by the recipient; provides that the potential of a firearm to cause injury shall not constitute a defective condition.  A companion bill, S1328, has been introduced in the Senate by Sen. Seward.

     Scoring a team score of 2232 in the final week of the 2002-2003 Orange County Pistol League season, Pleasantville pulled from 19 points behind the Middletown Pistol and Rifle Club, (MPRA,) to 9 points ahead to win for the 2nd year in a row. Pleasantville beat MPRA by one point last year.

 Spitzer quotes: ''We have the capacity to squeeze manufacturers like a pincers and hurt  them in the marketplace.,'' ''We are bigger than the NRA (National Rifle Association).''

     http://www.spitzer2006.com is AG Spitzer's new web site. It does not say that he is running for governor but that is the only office that is above him that will be open in 2006 and he will be a hard candidate to beat. He looks good, he talks good and he has spent his years in office bringing lawsuits against companies and gun manufacturers and wholesalers. He was even chosen as TIME's 2002 "Crusader of the Year". Some of the lawsuits against companies and Wall Street have been needed and he has won many but other articles, like one in FORTUNE, points out the weakness of his settlements and other problems. His lawsuit against the gun industry has been his biggest failure. He lost his main lawsuit but he still appealed the decision himself, the first time since being elected in 98 that he has personally appealed a decision in front of Appellate Judges. He wants the gun makers to: Ban crime-friendly gun models; Bar companies from supplying retailers who have a track record of selling to criminals; and Appoint a monitor to supervise the gun distribution system.
     Spitzer and Pres. Clinton's, (Bill not Hillary,) HUD secretary Cuomo who got local, (including Middletown), 18 state, and federal government officials to agree not to buy guns for law enforcement from gun makers that did not follow a "code of conduct," including mandatory design, distribution, and marketing reforms, to make guns safer and curtail their sale to criminals. This was the deal that only Smith & Wesson adopted and has now been discarded.

Reckless Lawsuit Bill Introduced In US Senate

      U.S. Senators Larry Craig (R-Id.)—also an NRA Director—and Max Baucus (D-Mont.) introduced the Senate’s version of reckless lawsuit preemption, S. 659, on Wednesday, March 19. Fifty-two Senators have signed on to this bill—which seeks to end the gun-ban lobby’s efforts to drive law-abiding firearm manufacturers into bankruptcy under the crushing weight of their predatory, illegitimate lawsuits—representing a majority of the Senate’s 100 members. With nine Democrats already signed on as cosponsors, including Senate Minority Whip Harry Reid (D-Nev.), as well as every Senate Republican who holds a leadership position, S. 659 has solid bipartisan and leadership support. Coupled with the February 27 introduction of the House version of reckless lawsuit preemption, H. R. 1036, the anti-gun extremists at the Brady Campaign/HCI must be gravely concerned Congress is prepared to remove one of the principal weapons from the gun-ban lobby’s arsenal.
But until reckless lawsuit preemption becomes law, the firearm and ammunition industry will continue to be subject to the threat of predatory litigation. HCI and anti-gun big city mayors will continue to shop for judicial venues where they can find judges and juries that are sympathetic to their gun-ban agenda.
HCI HAS A COW!!!
      Handgun Control, (now called the more politically correct Brady Campaign and the Brady Center to Prevent Gun Violence,) is having a cow and sent out a press release that list all of the sponsors and states, "We must block the bill with a filibuster ...". They also lie in their Press Release claiming that, "We must stop this legislation or the court doors will be slammed shut and gun violence victims will never have their day in court. Victims like the families who lost loved ones in the Washington, DC area sniper attacks, and the two New Jersey police officers, Ken McGuire and David Lemongello, who are seeking to hold a negligent West Virginia pawnshop responsible for its role in fueling the illegal gun market in New Jersey."
     Of course this legislation will not prevent any victim when a gun dealer or gun maker does something illegal. HCI wants to make sure that they are not prevented them from going to court against the gun industry any time anyone illegally obtains any gun and uses it illegally.
